2. Purpose

These Terms and Conditions regulate access, navigation, and use of this online store, as well as the purchase of products through it. Accessing the site implies full and unconditional acceptance of these Terms.

3. Contract Language

The contract may be concluded in Spanish or English. Both language versions of these Terms are equally binding. In case of conflict, the Spanish version shall prevail.

4. Legal Capacity

Users declare that they are of legal age (18+) and have the necessary legal capacity to contract the services offered on this website.

5. Ordering Process

  1. Select products and add them to the shopping cart.
  2. Provide billing and shipping details and select a payment method.
  3. A summary of the order, including prices and taxes, will be displayed before confirmation.
  4. The contract is concluded once the order is confirmed and HD PARTS AND ACCESSORIES, S.L. has received payment.
  5. You will receive an order confirmation email containing a summary of the contract terms, the products ordered, prices, shipping costs, and delivery information (Art. 63 RDL 1/2007). We recommend that you save or print this confirmation for your records.

6. Prices and Taxes

All prices displayed include VAT in accordance with Spanish legislation. Shipping costs are calculated separately and shown prior to order confirmation.

7. Payment Methods

The following payment methods are available:

  • Credit and debit cards (Visa, Mastercard)
  • PayPal
  • Bank transfer
  • SumUp

Payments are processed through secure platforms. The company does not store customer banking details.

8. Shipping and Delivery

Shipping times and conditions are detailed on the Delivery & Returns page.

Unless otherwise agreed, delivery will take place within a maximum of 30 calendar days from the conclusion of the contract (Art. 66 bis RDL 1/2007). US Warehouse items are an exception: by placing an order for these items you agree to an extended delivery period of up to 30 days from purchase, which may be further extended due to international logistics (see Section 8A). If we are unable to meet the applicable delivery deadline, we will inform you and you will have the right to cancel the order and receive a full refund.

Passage of risk: The risk of loss or damage to the goods passes to the consumer at the moment you or a third party designated by you (other than the carrier) takes physical possession of the goods (Art. 66 ter RDL 1/2007).

8A. US Warehouse Items

Items located in our United States warehouse are distinctly marked with a red banner on the product page. These items are typically sourced on-demand exclusively to fulfill your order.

  • Processing and Shipping Time: Due to international logistics and customs processing, the estimated shipping time for an order containing US Warehouse items is up to 30 days from the date of purchase. Please note that further processing or logistical delays may occasionally be required, extending the delivery window.
  • Cancellation and Returns/Exchanges Policy: Because these items are ordered on-demand and shipped internationally specifically for your order, the following rules apply:
    • Items Valued at €15 or More: Any request for cancellation (prior to dispatch) or return/exchange (after delivery) is subject to a mandatory restocking and processing fee. The penalty will be 15% of the item's value or €15, whichever amount is greater.
    • Items Valued at Less Than €15: Any US Warehouse item with a value of less than €15 is considered non-cancellable and non-returnable. No exceptions will be made.

This fee/restriction is necessary to cover the associated international ordering, shipping, and handling costs incurred when sourcing these exclusive items. By placing an order for a US Warehouse item, you acknowledge and accept this policy.

9. Right of Withdrawal

To exercise this right, you must notify us of your decision by a clear statement (e.g. email to [email protected]) before the deadline expires. You may use the model withdrawal form below, but it is not obligatory.

Customers are responsible for return shipping costs, unless the return is due to a defective product or an error attributable to the company.

9A. B2B Sales (Business Customers)

For purchases made by businesses or professionals (including orders placed with a company name and/or valid VAT number and intended for professional use):

  • No statutory 14-day withdrawal right: B2B transactions are not covered by the EU consumer right of withdrawal.
  • Returns by prior acceptance only: Any return requires prior written approval (RMA) from HD PARTS AND ACCESSORIES, S.L.
  • Restocking fee: Approved B2B returns are subject to a 15% restocking fee, deducted from the refundable amount. Shipping costs are non-refundable.

10. Warranties

Products sold to consumers are covered by the legal guarantee of conformity as established by applicable EU and national law:

  • In Spain, the legal guarantee is 3 years from delivery (RDL 1/2007, as amended).
  • In other EU Member States, the minimum guarantee is 2 years from delivery, though some countries provide longer periods under national law.
  • For second-hand goods, the guarantee period may be reduced by agreement, but in no case to less than 1 year.

In the case of a non-conforming product, the company will repair, replace, reduce the price, or terminate the contract as appropriate, at no cost to the consumer.

For B2B purchases, the warranty is governed by applicable commercial law.

11. Liability and Force Majeure

HD PARTS AND ACCESSORIES, S.L. is not liable for delays or failures caused by events genuinely beyond its control (natural disasters, strikes, government actions, epidemic, interruption of supply chains) provided these events are unforeseeable, unavoidable, and not attributable to the company.

In the event of force majeure preventing delivery, consumers retain the right to cancel the affected order and receive a full refund in accordance with consumer protection law.

Access to the site may be interrupted for maintenance reasons.

12. Intellectual Property

All content on the site (texts, images, logos, trademarks, source code) is protected by intellectual and industrial property laws. Reproduction, distribution, or use without express authorization is prohibited.

13. Data Protection

The processing of personal data is governed by our Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

15. Governing Law and Jurisdiction

These Terms are governed by Spanish law. For the resolution of any dispute:

  • Consumers (B2C): may bring proceedings before the courts of their habitual place of residence, in accordance with applicable consumer protection legislation.
  • Business customers (B2B): the parties submit to the Courts of Huelva (Spain).
